NEWS RELEASE · 3rd January 2012
Gitxsan Against Enbridge
Court Date

There is a rumour happening on Facebook and other places that there will be a court appearance for January 4th. Please note that there is no court date set yet, though it may happen very soon.

Here's what's happened:

The fired GTS staff got an ex-parte (done without hearing the other side) injunction against the Gitxsan Hereditary Chiefs less than 48 hours after the Chiefs Office was closed. The Chiefs have 21 days to respond to this injunction - this is the deadline this week.

The GTS staff and their high-priced lawyers have been pressuring the RCMP to enforce the injunction before the Judge has a chance to hear from our side.

Here's what will happen:

The Hereditary Chiefs have retained a lawyer to respond to the injunction. It will be essential to show support by having Chiefs and members involved. An all-clans meeting will happen soon to discuss next steps. A future court date may be set.

All of this court action could be averted if the current GTS board would respect the will and instructions of the Chiefs. The GTS has been spending many, many thousands of Gitxsan dollars on wages, bonuses (GTS board members each received $2,000 for Christmas), "honourariums," and legal fees to sue their own Chiefs. The December 5th Declaration has been signed by 45 chiefs. The number of hereditary chiefs is approximately 65 depending on protocol processes.

The Unity Movement is 100% volunteer driven, and is supported by a vast majority of our people.
