Panel Response to Communications
From time to time, the National Energy Board (NEB), the Canadian Environmental Assessment Agency (CEAA), and the Joint Review Panel (Panel) receive comments or requests about the Enbridge Northern Gateway Project (Project) from participants and members of the public with an expectation of a reply.
As the Panel has been established to review the Project, NEB and CEAA officials cannot respond, but rather will forward these letters to the Panel for its consideration. The Panel will read these communications and place them on the record for transparency. It would also be procedurally inappropriate for the Panel to respond to these communications.
Questions regarding details of the Project can be directed to Northern Gateway (applicant) at any time. The Hearing Order sets out the procedures for participants to follow in order for questions and responses to be placed on the public record. It can be found on the Panel’s website at www.gatewaypanel.review.gc.ca.1
Although the deadline to register for Intervenor status has passed, section 4 of the Hearing Order sets out the process to apply to the Panel for late Intervenor status.
If any person wants to request a decision of the Panel regarding the process which has been established for the joint review, they should send the request to the Panel in the form of a notice of motion. The process for motions can be found in section 10 of the Hearing Order. In order to be fair, the Panel may seek comments from parties to the joint review process before making a decision or providing a response to the motion.
